A program to provide lawful permanent resident (LPS) status to foreign investors (and their spouses and unmarried children under the age of 21) who invest a specified amount of capital in a new commercial enterprise (NCE) in the United States that creates at least 10 jobs for 2 years.  It is administered by the U.S. Citizenship and Immigration Services (USCIS), a component of the Department of Homeland Security (DHS), and it was enacted in March 2022 through the EB-5 Reform and Integrity Act of 2022 (“2022 Act”).  Also referred to as the EB-5 Regional Center Program.
